Nevada Supreme Court Allows Reproductive Rights Petition to Appear on 2024 Ballot

WASHINGTON, D.C. – On Thursday, the Supreme Court of Nevada ruled unanimously in favor of Nevadans for Reproductive Freedom, after Elias Law Group attorneys representing the organization appealed a previous district court ruling that prevented the Nevada Secretary of State from placing a measure creating a fundamental constitutional right to reproductive freedom on the ballot in 2024.

“The district court erred when it [...] enjoined the Secretary of State from placing the measure on the ballot. The initiative petition has a single subject: the establishment of a fundamental right to reproductive freedom. All the provisions of the initiative petition are germane or functionally related to that subject. [...] Accordingly, we reverse the district court's order enjoining the Secretary of State from placing the initiative petition on the 2024 ballot,” wrote Justice Lidia S. Stiglich.

Elias Law Group partner David Fox, representing Nevadans for Reproductive Freedom, successfully argued this case before the Supreme Court of Nevada last month.

“We are thrilled that the Supreme Court of Nevada ruled in favor of our client, Nevadans for Reproductive Freedom. This ruling is a victory for Nevada voters and a clear affirmation of their right to pursue a ballot measure granting every Nevadan the right to make their own decisions related to pregnancy, childbirth, abortion, and all aspects of reproductive health. Elias Law Group is proud to stand with Nevadans for Reproductive Freedom and other organizations around the country committed to defending reproductive rights,” said Elias Law Group partner David Fox.
